US Supreme Court Blocks Trump’s Birthright Citizenship Ban

The US Supreme Court has ruled against former President Donald Trump’s executive order seeking to end birthright citizenship in the United States, the court decided on Tuesday.

The ruling blocks the executive order that would have banned automatic citizenship for children born in the US to non-citizen parents.

Birthright citizenship is currently protected under the 14th Amendment of the US Constitution, which grants citizenship to all persons born or naturalized in the country.

The Supreme Court’s decision means the policy will not take effect, maintaining the existing constitutional right for now.

Trump Says ‘Too Bad for Our Country, Urges Congress to act’

In a 6-3 decision, the court said Trump’s directive violated the 14th Amendment, which grants citizenship to all persons born or naturalized in the US. Chief Justice John Roberts wrote: “We keep that promise today”. 

Following the ruling, Trump condemned the decision on his Truth Social platform.

He called it “too bad for our Country” and said “The Supreme Court upheld Birthright Citizenship, which is too bad for our Country.

Trump pivoted to Congress, urging lawmakers to act instead. “No long and unwieldy Constitutional Amendment is necessary! Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support!”. 

He also wrote earlier that “The United States of America cannot live with the shackles of Birthright Citizenship. It is not economically, or otherwise, sustainable”. 

What Happens Next

The ruling blocks Trump’s order from taking effect nationwide. Children born in the US will continue to receive automatic citizenship, except in limited cases like children of foreign diplomats.

Legal experts say any attempt by Congress to restrict birthright citizenship through legislation would likely face fresh court challenges, because five justices found the Constitution itself protects.
